General conditions

(pursuant to Chapter I, title 3, part 3, of Legislative Decree 206/2005 and subsequent amendments and additions)

1. Introduction and effectiveness of the General Conditions

These general conditions of sale (hereinafter, "General Conditions") have as their object the regulation of the purchase of products, carried out remotely and made available via the internet, from the site https://www.artemisiabio.com (hereinafter , the “Site”) in compliance with Italian legislation, pursuant to Legislative Decree 206/2005 and subsequent amendments and additions (hereinafter, “Consumer Code”).

The seller of the products and owner of the Site is: Artemisia bio di Brunetti Isabella, with registered and production headquarters in Via Mondovì 18, Beinette 12081 (CN). PI:03718220043.

The consumer who accesses the Site to make purchases (hereinafter "Customer") is required, before sending the order, to carefully read these General Conditions which have been made available to him on the Site and which will be available for consultation at any time. by the Customer also through the link contained in the confirmation email of each order to allow its reproduction and storage.

In the event that the person making purchases on the Site requests the issuing of an invoice and/or in any case is not a "consumer or user" as defined in the art. 3, paragraph 1, letter. a, of the Consumer Code, the withdrawal regulations referred to in the art. will not apply. 7 of these General Conditions nor, more generally, the provisions which pursuant to the same Consumer Code apply only to "consumers".

Contracts concluded through the Site are governed by these General Conditions in compliance with Italian law. The language available to conclude the contract is Italian.

2. Choose and order the Products

The characteristics and prices of the various products on sale on the Site (hereinafter "Product" or "Products") are shown on the page relating to each Product.

To purchase the Products, the Customer must complete and send the order form in electronic format, following the instructions contained in the Site. The Customer must add the Product to the "Cart" and, after having read the General Conditions and the Policy of Privacy and confirmed their acceptance, you will have to enter the shipping and possible invoicing data, select the desired payment method and confirm the order.

By sending the order from the Site, which has the value of a contractual proposal, the Customer acknowledges and declares to have read all the information provided during the purchase procedure and to fully accept these transcribed General and Payment Conditions.

The contract stipulated between the Supplier and the Customer must be considered concluded with the acceptance of the order by the company Artemisia bio di Brunetti Isabella, acceptance which is communicated to the Customer through an email confirming the order itself, containing a reference to the these General Conditions, the order number, shipping and billing data, the list of Products ordered with their essential characteristics and the overall price, including delivery costs. If the Customer finds errors in the order placed, it will be possible to cancel the order within the following 24 hours from receiving the confirmation email, by sending an email to the email address shop@artemisiabio.com or by calling 3311475107/3428025325. After this deadline, the order will be processed for shipment and changes or cancellations will no longer be accepted, without prejudice to the Customer's rights referred to in article 7 below.

Once the order has been received, the company will check warehouse availability to process the order itself. In the event that one or more Products are unavailable, timely communication will be sent via e-mail to the Customer, who, within the following 24 working hours, will have the right to respond to confirm the shipment of the available Products, provided that the order the overall shipment item meets the minimum order requirement, or cancel it. In case of failure to respond within this period, the order will be considered automatically cancelled.

If the order is confirmed, the amount relating to the missing products will be canceled depending on the payment method chosen.

3. Product Information

The information and characteristics relating to the Products are available, with the relevant Product codes, on the Site.

The visual representation of the Products on the Site, where available, normally corresponds to the photographic image accompanying the descriptive sheet. It is understood that the image of the Products themselves has the sole purpose of presenting them for sale and may not be perfectly representative of their characteristics and quality but may differ in color and size.

In the event of a difference between the image and the product sheet, the description on the product sheet always prevails.

4. Prices and shipping

Product prices include all legal taxes and duties. All prices are expressed in euros.

· Shipments to Italy:

Throughout Italy, shipping is free for amounts over €75, for amounts under €75 the shipping cost is €7.00.

· Shipments abroad:

The cost of shipping abroad varies depending on the destination and will be processed upon request for a quote from the customer.

5. Payment and invoicing methods

5.1 Payment methods

Payment of the price of the Products and the related delivery costs can be made by credit cards, PayPal or prepaid cards, or bank transfer.

· PayPal-Prepaid or credit cards

Once the order has been confirmed, the Customer will be redirected to the PayPal site where he can make the payment with his account or using a card, including a prepaid one, or in any case according to the methods accepted by Paypal and his credit institution and in compliance with the related conditions.

· Bank transfer

Once the order has been confirmed, the details for making the payment via bank transfer will be indicated. We ask if it would be possible to send a confirmation by sending the payment accountant via email to shop@artemisiabio.com.

Once the order has been confirmed, the Customer will be redirected to the Satipay page where he can make the payment with his account in compliance with the relevant conditions.

5.2 Invoicing of orders

If the purchase is made by a company with a VAT number, it will be possible to request an invoice by writing to the e-mail address: shop@artemisiabio.com, entering the electronic invoicing data - including the tax code and/or VAT number , unique code/PEC - in the appropriate form to be filled in before completing the order. The professional is responsible for the correct insertion of the billing data and is expressly informed that, in case of failure to request the invoice during the order phase, it will not be possible to request it later.

6. Transport and delivery

The Products purchased on the Site will be delivered to the address indicated by the Customer during the purchase procedure in the appropriate "Shipping Data" field.

All purchases will be delivered by express courier (hereinafter, "Courier") from Monday to Friday, excluding holidays and national holidays.

The company is not responsible for delays that are not foreseeable or in any case not attributable to it.

The user is required to make a person available for unloading, indicated in the "destination of goods" field on the basis of the delivery confirmation received from the courier via text message or e-mail.

7. Right of withdrawal

The exercise of the right of withdrawal is subject to sending the supplier a communication by suitable means (email to shop@artemisiabio.com or registered letter with return receipt) no later than 14 days from receipt of the product.

Once the communication has been received, the company will open a procedure for managing the return, without prejudice to the fact that the cost of returning the product is borne by the customer.

The right of withdrawal is governed by the following conditions:

1. The Customer has the right to withdraw from the purchase contract only in the event that the product received does not conform to the order confirmation or product sheet, or in the event of transport damage which compromises its usability (e.g. in case of breakage, crushing, contamination), provided that such damage is documented at the time of delivery with a specific signature on the courier's tablet.

2. The refund is subject to the receipt of the Product by Artemisia bio di Brunetti Isabella, which, having verified the damage or non-conformity, will provide the refund with the same payment method used by the customer during the purchase of the Products.

3. Errors and limitations of liability

The information relating to the Products provided through the Site is constantly updated. However, it is not possible to guarantee the complete absence of errors for which, therefore, Artemisia bio di Brunetti Isabella cannot be considered responsible, except in cases of willful misconduct or gross negligence.

Artemisia bio di Brunetti Isabella reserves the right to correct errors, inaccuracies or omissions even after an order has been sent, or to modify or update information at any time without prior communication, without prejudice to the Customer's rights pursuant to of these General Conditions and the Consumer Code.

Except for willful misconduct or gross negligence, any right of the Customer to compensation for damages or recognition of compensation is excluded, as well as any contractual or non-contractual liability for direct or indirect damage to people and/or things, caused by non-acceptance or evasion, even partial. , of an order.

9. Complaints

10. Applicable law and competent court

The sales contract between the Customer and the supplying company Artemisia bio di Brunetti Isabella is concluded in Italy and regulated by Italian law. For the resolution of disputes relating to the interpretation, execution or resolution of these General Conditions or individual purchase orders, the Court of Cuneo will have exclusive jurisdiction.
